Crushly is an AI-powered entertainment platform.
All conversations, characters, personalities, images, messages and other content available through the Service are generated entirely by artificial intelligence.
Users do not communicate with real people through the Service.
Crushly does not employ human chat operators, human companions or individuals who communicate with users on behalf of AI characters.
All characters are fictional and generated by AI.
Users acknowledge and agree that every interaction on the Service takes place exclusively with artificial intelligence and never with a human operator or another user.
Crushly is intended exclusively for adults.
You must be at least 18 years old, or the legal age of majority in your jurisdiction (whichever is higher), to use the Service.
By using Crushly you confirm that you satisfy this requirement.
You are responsible for maintaining the confidentiality of your login credentials.
You agree to provide accurate information when creating your account.
You are responsible for all activity occurring under your account.
Accounts are personal and may not be shared, transferred or sold to any other person.
We reserve the right to suspend or terminate accounts that violate these Terms.

You should not rely on AI-generated responses when making important personal, legal, medical or financial decisions.
Crushly is a fictional AI experience.
AI characters cannot establish real-world relationships, friendships or romantic partnerships.
AI characters cannot meet users in person, make real-world arrangements or provide real-life services.
Users acknowledge that AI characters may simulate emotions, affection, intimacy, companionship or personal relationships as part of the fictional experience. Such interactions are entirely artificial and do not represent genuine human emotions, intentions or commitments.
Images available through the Service are generated using artificial intelligence.
They may depict fictional persons and fictional scenarios.
Any resemblance to real persons is purely coincidental unless explicitly stated otherwise.
Certain features of the Service require the purchase of virtual credits or subscriptions.

Payments are securely processed by trusted third-party payment providers.
Unused credits remain associated with your account and do not constitute property, stored monetary value, or any ownership interest.
Unless required by applicable law, purchases of digital services, subscriptions and virtual credits are non-refundable once the purchased functionality has been made available.
If you believe that a billing error has occurred or wish to request a refund, you may contact us.
We will review your request and respond within 14 calendar days of receiving all necessary information required to process your request.
Nothing in these Terms limits any mandatory consumer rights that cannot be excluded under applicable law.

The Service may automatically detect, refuse, limit or block prompts or requests that violate these Terms, applicable law or our internal safety policies.
We reserve the right to investigate suspected misuse of the Service, suspend or permanently terminate accounts involved in prohibited activity, and, where required by applicable law, cooperate with competent authorities.
By using the Service, you acknowledge that you remain solely responsible for the prompts, requests and instructions you submit. Attempting to use the Service for unlawful purposes or to generate prohibited content constitutes a violation of these Terms of Use.
Repeated or serious violations may result in the permanent suspension of your account without refund, where permitted by applicable law.
By submitting prompts, messages or other content through the Service, you grant SIRTEMED LTD a limited, non-exclusive, worldwide license to process such content solely for the purpose of operating, maintaining, securing and improving the Service, in accordance with our Privacy Policy.
All software, designs, graphics, trademarks, logos, AI characters, generated assets and other materials available through the Service are owned by or licensed to SIRTEMED LTD.
Except where expressly permitted, you may not reproduce, distribute, modify or commercially exploit any part of the Service.
We reserve the right to add, modify, suspend or remove any feature, AI model, character, functionality or portion of the Service at any time, with or without notice.
We are under no obligation to maintain any specific AI character, conversation history, feature or functionality.
We strive to keep the Service available at all times.
However, we do not guarantee uninterrupted availability and may suspend, modify or discontinue any part of the Service without prior notice.
We shall not be liable for any failure or delay in performing our obligations where such failure results from events beyond our reasonable control, including but not limited to natural disasters, internet outages, cyberattacks, governmental actions, labor disputes, power failures or failures of third-party service providers.
We may suspend or permanently terminate your account, including without prior notice where necessary to protect the Service, other users, or comply with applicable law, if you:

To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent permitted by applicable law, SIRTEMED LTD shall not be liable for any indirect, incidental, consequential, special or punitive damages arising from your use of the Service.
Our total liability shall not exceed the total amount actually paid by you to the Service during the twelve (12) months preceding the event giving rise to the claim.
Your use of the Service is also governed by our Privacy Policy.
We may update these Terms from time to time.
The updated version becomes effective immediately upon publication.
Your continued use of the Service constitutes acceptance of the revised Terms.
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Cyprus, without regard to conflict of law principles.
Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Cyprus, unless applicable law requires otherwise.
